New Mexico Expungements in a Nutshell
You may petition to expunge New Mexico arrest information for misdemeanors and petty misdemeanors, provided the arrest was not for a crime of moral turpitude. Also, arrest records may be sealed if the final disposition cannot be located. N.M. Stat. Ann. § 29-3-8.1.
You may also apply to the court for an order to expunge arrest records if the underlying charge was drug possession, it was your first offense, it was committed when you were under age 18, and the charges were ultimately dismissed following a conditional discharge. N.M. Stat. Ann. § 30-31-28.
Adult convictions may not be sealed.

The Caregivers Criminal History Screening program requires that persons whose employment or contractual service with a care provider includes direct care or routine and unsupervised physical or financial access to any care recipient served by that provider must undergo a nationwide criminal history screening.
