Iowa Criminal History Expungement & Record Sealing in a Nutshell
Most criminal records cannot be removed from a person’s Iowa criminal history. The only two times the Court would consider expunging a criminal record are:
- The outcome of the case is a “Deferred Judgment” (not a conviction) and the person has successfully completed probation, or
- The conviction is for Public intoxication, Consumption, or Underage possession of alcohol and the person has not had any new convictions for at least two years after the conviction.
Completed deferred judgments that do not end in conviction will automatically be put on a private list. This list can only be seen by Courts, court staff, the department of corrections, county attorney’s office, and law enforcement. If the completed deferred judgment was from:
- After July 1, 2013, it will automatically be placed on a private list.
- Before July 1, 2013, the person will need to apply for expungement, placing the record on the private list.
Effective July 1, 2010, Iowa law provides a process to expunge a record for certain alcohol related offenses, specifically violations of Iowa Code chapters 123.46 and 123.47. The process for requesting to expunge a record of conviction for those offenses is identified in Iowa Code chapters 123.46(5) and 123.47(7).
There are no other alternatives to remove any other type of adult criminal record in Iowa. The court cases will continue to appear on the online court docket.
- It does not matter how long ago it happened.
- It does not matter whether it’s a felony or a misdemeanor.
- It does not matter whether it was a dismissal, finding of innocence, or a conviction.
If charges were filed against you as a juvenile, the information was entered into the Iowa Courts Online database. Juvenile records can later be expunged, but not in all cases. You can ask a judge to seal them, but several provisions must be met. Those include being at least 18 years old and waiting until two years have passed since the last “official action” in your case.
